Discussion Question:

Is it proper for a Judge to strike down a law because he disagrees with the Legislature as to whether the law they passed involves any of those factors? Should the Judiciary be substituting their own judgements in place of a State Legislature as to whether the law is effective or good or moral or acting in the welfare of the public? Should Judges have the power to override the Legislature’s judgment that conditions in bakeshops were unsafe?
